Amestella Terms of Service

1. General Provisions

These Terms of Service ("Terms") govern the use of the Amestella fortune-telling entertainment application ("the App") provided by Grosbeak Inc. ("we," "us," or "our"). By accessing or using the App, you ("the User") agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Service Description

  1. The App is a fortune-telling entertainment application that integrates multiple Eastern and Western divination systems, including Kabbalistic Numerology, Four Pillars of Destiny (BaZi), Sanmei-gaku, Zi Wei Dou Shu, Western Astrology, Sukuyo Astrology, Nine Star Ki, Feng Shui, and Tarot.
  2. The App is provided for entertainment purposes only. Fortune results are intended to be enjoyed as entertainment.
  3. The App is available on iOS, Android, and web browsers.

3. Account Registration

  1. To use the App, you must register an account using Google Sign-In, Sign in with Apple, or email and password.
  2. You agree to provide accurate and current information during registration.
  3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  4. You may not transfer, sell, or share your account with any third party.
  5. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Entertainment Disclaimer

  1. All fortune results, horoscope readings, compatibility analyses, AI-generated interpretations, and any other content provided through the App ("Fortune Content") are provided solely for entertainment purposes.
  2. Fortune Content does not constitute and should not be relied upon as medical, legal, financial, investment, psychological counseling, or any other form of professional advice.
  3. You should always consult qualified professionals for important decisions regarding health, legal matters, finances, and other significant life choices. We accept no liability for any decisions or actions taken based on Fortune Content.
  4. We make no warranties or representations regarding the accuracy, completeness, usefulness, or fitness for a particular purpose of Fortune Content.

5. Subscriptions

5.1 Subscription Plans

We offer the following subscription plans:

Prices in currencies other than Japanese Yen are determined by Apple App Store or Google Play Store and may vary by region.

5.2 Auto-Renewal

  1. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  2. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.
  3. Payment is processed through your Apple ID or Google account.

5.3 Cancellation

You may cancel your subscription at any time through the following methods:

For iOS users:
Settings app > Your name (Apple ID) > Subscriptions > Select "Amestella" > Cancel Subscription

For Android users:
Google Play Store app > Menu > Subscriptions > Select "Amestella" > Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.

5.4 Free Trials

  1. If a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.
  2. Any unused portion of a free trial will be forfeited upon purchase of a paid subscription.

5.5 Restore Purchases

If you change devices or reinstall the App, you may restore your active subscription using the "Restore Purchases" feature within the App.

6. In-App Currency ("Pentacles")

6.1 Overview

  1. Pentacles are an in-app virtual currency that can be used to access certain features within the App.
  2. Pentacles can be purchased through in-app purchases.

6.3 Terms of Use

  1. Pentacles may only be used within the App.
  2. Pentacles cannot be exchanged for cash, other currencies, securities, or any other items of monetary value.
  3. Pentacles cannot be transferred, sold, or exchanged between users.
  4. Upon account deletion, unused Pentacles will be forfeited and are not eligible for a refund.

6.4 Refunds

  1. Refunds for Pentacle purchases are subject to the refund policies of the Apple App Store or Google Play Store.
  2. For refund inquiries, please contact the respective store's support team.

7. Prohibited Conduct

You agree not to engage in any of the following activities while using the App:

  1. Violating any applicable laws, regulations, or public order and morals
  2. Engaging in or facilitating criminal activity
  3. Infringing upon the intellectual property rights, portrait rights, privacy, reputation, or other rights of us or any third party
  4. Placing excessive load on our servers or network infrastructure
  5. Interfering with or disrupting the operation of the App
  6. Attempting unauthorized access to the App, its servers, or related systems
  7. Collecting or storing personal information of other users
  8. Impersonating another user or person
  9. Using the App to directly or indirectly benefit antisocial forces
  10. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the App
  11. Using fortune results for commercial purposes without authorization
  12. Any other conduct that we deem inappropriate

8. Intellectual Property

  1. All intellectual property rights in the App and its content (including text, images, designs, logos, software, divination algorithms, and AI model outputs) belong to us or our authorized licensors.
  2. You may not reproduce, redistribute, modify, or otherwise use the App's content without our prior written consent.
  3. Ownership of personal information and fortune result data you register in the App remains with you.

9. Service Modifications, Interruptions, and Termination

  1. We may modify, suspend, or terminate the App or any part thereof without prior notice to users.
  2. We are not liable for any damage arising from actions taken under this section.
  3. In the event of service termination, we will endeavor to provide reasonable advance notice.

10. Limitation of Liability

  1. The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
  3. In any case, our total liability to you for all claims arising out of or related to the App shall not exceed the total amount of fees paid by you to us during the month in which the damage occurred.
  4. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

12. Account Deletion

  1. You may request deletion of your account through the Settings screen within the App.
  2. Upon account deletion, all data associated with your account (personal information, fortune results, pet information, transaction history, etc.) will be permanently deleted.
  3. Deleted data cannot be recovered.
  4. If you have an active subscription, please cancel it before deleting your account. Account deletion alone does not cancel auto-renewal.

13. Modifications to These Terms

  1. We reserve the right to modify these Terms at any time.
  2. Updated Terms take effect when posted within the App.
  3. Your continued use of the App after the posting of modified Terms constitutes your acceptance of such modifications.
  4. For changes that materially affect your rights, we will endeavor to provide reasonable advance notice.

14. Notices

  1. Notices from us to you may be delivered through in-app notifications, push notifications, or email sent to the address registered with your account.
  2. Such notices are deemed received at the time of dispatch.

15. Assignment

You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent.

16. Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the Nara District Court as the court of first instance.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
