Amestella Terms of Service

1. General Provisions

These Terms of Service ("Terms") govern the use of the Amestella fortune-telling entertainment application ("the App") provided by Grosbeak Inc. ("we," "us," or "our"). By accessing or using the App, you ("the User") agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Definitions

In these Terms, the following terms have the meanings set out below:

  1. "the App" means the Amestella fortune-telling entertainment application provided by us (including the software required to use it and our related websites).
  2. "User" means any person who agrees to these Terms and uses the App.
  3. "Account" means the identifier issued or registered by us to identify a User.
  4. "Content" means any text, images, audio, video, programs, fortune results, AI-generated outputs, and other information available through the App.
  5. "Fortune Content" means the fortune results, horoscope readings, compatibility analyses, AI-generated interpretations, and other divination-related content provided by the App.
  6. "Paid Services" means any services or content within the App that require payment by the User (including subscriptions and Pentacle purchases).
  7. "Pentacles" means the in-app virtual currency that can be used to access certain features within the App.

3. Service Description

  1. The App is a fortune-telling entertainment application that integrates multiple Eastern and Western divination systems, including Kabbalistic Numerology, Four Pillars of Destiny (BaZi), Sanmei-gaku, Zi Wei Dou Shu, Western Astrology, Sukuyo Astrology, Nine Star Ki, Feng Shui, and Tarot.
  2. The App is provided for entertainment purposes only. Fortune results are intended to be enjoyed as entertainment.
  3. The App is available on iOS and Android.

4. Account Registration

  1. To use the App, you must register an account using Google Sign-In, Sign in with Apple, or email and password.
  2. You agree to provide accurate and current information during registration.
  3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  4. You may not transfer, sell, or share your account with any third party.
  5. We are not liable for any loss or damage arising from unauthorized use of your account. We may treat any activity conducted through your account as an act of the User who holds that account.

5. Entertainment Disclaimer

  1. All fortune results, horoscope readings, compatibility analyses, AI-generated interpretations, and any other content provided through the App ("Fortune Content") are provided solely for entertainment purposes.
  2. Fortune Content does not constitute and should not be relied upon as medical, legal, financial, investment, psychological counseling, or any other form of professional advice.
  3. You should always consult qualified professionals for important decisions regarding health, legal matters, finances, and other significant life choices. We accept no liability for any decisions or actions taken based on Fortune Content.
  4. We make no warranties or representations regarding the accuracy, completeness, usefulness, or fitness for a particular purpose of Fortune Content.

6. Subscriptions

6.1 Subscription Plans

We offer the following subscription plans:

Prices in currencies other than Japanese Yen are determined by Apple App Store or Google Play Store and may vary by region.

6.2 Auto-Renewal

  1. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  2. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.
  3. Payment is processed through your Apple ID or Google account.

6.3 Plan Changes

  1. You may switch between the monthly and yearly plans from the Premium plan screen within the App.
  2. A plan change generally takes effect at the end of your current billing period (at the next renewal), at which point the new plan's price will be charged. Your current plan continues to apply until then.

6.4 Cancellation

You may cancel your subscription through the store where you purchased it, as follows:

If you purchased through the App Store (iOS):
Settings app > Your name (Apple ID) > Subscriptions > Select "Amestella" > Cancel Subscription

If you purchased through Google Play (Android):
Google Play Store app > Menu > Subscriptions > Select "Amestella" > Cancel Subscription

You cannot cancel a subscription from a store other than the one where it was purchased (for example, you cannot cancel an App Store subscription through Google Play). Please cancel through the store of purchase. Cancellation takes effect at the end of the current billing period, and you will retain access to premium features until then.

6.5 Free Trials

  1. If a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.
  2. Any unused portion of a free trial will be forfeited upon purchase of a paid subscription.

6.6 Restore Purchases

If you change devices or reinstall the App, you may restore your active subscription using the "Restore Purchases" feature within the App.

7. In-App Currency ("Pentacles")

7.1 Overview

  1. Pentacles are an in-app virtual currency that can be used to access certain features within the App.
  2. Pentacles can be purchased through in-app purchases.

7.3 Terms of Use

  1. Pentacles may only be used within the App.
  2. Pentacles cannot be exchanged for cash, other currencies, securities, or any other items of monetary value.
  3. Pentacles cannot be transferred, sold, or exchanged between users.
  4. Upon account deletion, unused Pentacles will be forfeited and are not eligible for a refund.

7.4 Refunds

  1. Refunds for Pentacle purchases are subject to the refund policies of the Apple App Store or Google Play Store.
  2. For refund inquiries, please contact the respective store's support team.

8. Minors

  1. If a minor uses the App, they must do so with the prior consent of a parent or legal guardian. In particular, the use of any Paid Services, including subscription and Pentacle purchases, requires the consent of a parent or legal guardian.
  2. The monthly amount a minor may spend on Paid Services is limited as follows:
    • Under 16 years of age: up to JPY 5,000 per month
    • 16 to under 18 years of age: up to JPY 20,000 per month
    If Paid Services are provided in excess of these limits due to inaccurate age information provided by the User during the purchase process, we are unable to refund the amount exceeding the limit.
  3. If a minor uses the App by falsely claiming to have obtained the consent of a legal guardian, by misrepresenting themselves as an adult, or by otherwise using deceptive means as defined in Article 21 of the Civil Code of Japan, the minor may not rescind any legal act arising from such use.
  4. If a User who was a minor at the time of agreeing to these Terms uses the App after reaching the age of majority, such use shall be deemed to constitute ratification of all prior legal acts relating to the use of the App.

9. Fees and Costs

  1. All costs associated with purchasing and maintaining the device required to use the App, communication charges (packet/data charges, etc.), and any other related costs shall be borne by the User.
  2. We may change the price or other conditions of Paid Services at our discretion. In such cases, the revised prices will be displayed at each point of sale. If you do not agree to the revised terms, you may be unable to use all or part of the relevant Paid Services.

10. Prohibited Conduct

  1. You agree not to engage in any of the following activities while using the App:
    1. Violating any applicable laws, regulations, or public order and morals
    2. Engaging in or facilitating criminal activity
    3. Infringing upon the intellectual property rights, portrait rights, privacy, reputation, or other rights of us or any third party
    4. Placing excessive load on our servers or network infrastructure
    5. Interfering with or disrupting the operation of the App
    6. Attempting unauthorized access to the App, its servers, or related systems
    7. Collecting or storing personal information of other users without their consent
    8. Impersonating another user, person, or us
    9. Using the App to directly or indirectly benefit antisocial forces
    10. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the App
    11. Trading Pentacles, accounts, or other rights or benefits within the App for cash, goods, or other economic benefits (so-called real-money trading), or engaging in any preparatory act thereof
    12. Using, creating, distributing, or selling external tools, bots, cheat tools, other technical means not provided by us, or modified devices, or using any of these to manipulate the App improperly
    13. Holding multiple accounts improperly, or sharing an account with others, without our approval (including for the purpose of improperly obtaining login bonuses, referral code rewards, or other benefits)
    14. Intentionally inducing or exploiting bugs in the App, or using the App for purposes other than those intended
    15. Using fortune results or other content for commercial purposes without our authorization (except in accordance with our separately established Streaming & Content Guidelines)
    16. Any other conduct that we deem inappropriate
  2. If we determine that you have engaged in, or are likely to engage in, any of the conduct listed above, or if we otherwise determine that your use of the App is inappropriate, we may, without prior notice, take any or all of the following measures. We are under no obligation to disclose the reasons, details, or duration of such measures, and you may not object to them.
    1. Requesting that you cease the conduct and refrain from repeating it
    2. Revoking Pentacles, benefits, or other interests you have acquired within the App
    3. Suspending your access to all or part of the App
    4. Suspending or deleting your account
    5. Revoking rights obtained through the prohibited conduct
    6. Reporting to the police or other public authorities where there is a risk of a violation of law
    7. Any other measures we deem necessary and appropriate
  3. We are not liable for any damage arising from the measures described in the preceding paragraph. We may also decline to provide our services, including the App, to any User subject to such measures, and may retain personal information to the extent necessary.

11. Intellectual Property

  1. All intellectual property rights in the App and its content (including text, images, designs, logos, software, divination algorithms, and AI model outputs) belong to us or our authorized licensors.
  2. You may not reproduce, redistribute, modify, or otherwise use the App's content without our prior written consent.
  3. Ownership of personal information and fortune result data you register in the App remains with you.

12. Service Modifications, Interruptions, and Termination

  1. We may modify, suspend, or terminate the App or any part thereof without prior notice to users.
  2. We are not liable for any damage arising from actions taken under this section.
  3. In the event of service termination, we will endeavor to provide reasonable advance notice.

13. Advertising

We may, at our discretion, display advertisements from us or third parties within the App. We are not responsible for the content of such advertisements or for any transactions, communications, or other dealings between advertisers and Users.

14. Limitation of Liability

  1. The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, nor for damage caused by events beyond our reasonable control (such as natural disasters, communication line failures, or system maintenance) or by the acts of third parties (such as unauthorized access or computer viruses).
  3. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

15. Damages

  1. If you violate these Terms or cause damage to us or any third party (including but not limited to reasonable attorneys' fees) in connection with your use of the App, you shall compensate for such damage.
  2. Where we are liable to you for damages due to reasons attributable to us in connection with the App, our liability shall be limited to the total amount of fees paid by you to us during the month in which the damage occurred, except in cases of our intentional misconduct or gross negligence.

16. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

17. Account Deletion

  1. You may request deletion of your account through the Settings screen within the App.
  2. Upon account deletion, all data associated with your account (personal information, fortune results, pet information, transaction history, etc.) will be permanently deleted.
  3. Deleted data cannot be recovered.
  4. If you have an active subscription, please cancel it before deleting your account. Account deletion alone does not cancel auto-renewal.

18. Modifications to These Terms

  1. We may modify these Terms in accordance with applicable law. When we modify these Terms, we will notify you of the modified content and its effective date in advance by posting within the App or on our website.
  2. The modified Terms take effect from the effective date specified above.
  3. Your continued use of the App after the modified Terms take effect constitutes your acceptance of the modifications.

19. Notices

  1. Notices from us to you may be delivered through in-app notifications, push notifications, or email sent to the address registered with your account.
  2. Such notices are deemed received at the time of dispatch.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent.

21. Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the Nara District Court as the court of first instance.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. If any provision is held invalid or rescinded with respect to a particular User, these Terms shall remain in effect with respect to all other Users.
